1.   FOREWORD

The following information describes to our users the types and operating modes of Cookies and other tracking tools used by our website www.cremonini.com and also explains what actions are to be undertaken to refuse or eliminate them.

2.   DATA CONTROLLER

The data controller is Cremonini S.p.A (hereinafter “Cremonini” or “Controller”) with registered offices in via Modena 53, Castelvetro di Modena (MO), VAT number: 0016281036, (Email: communication@cremonini.com, PEC: communications@pec.cremonini.com, switchboard +39 059 754611). Cremonini will process your personal data in compliance with EU Regulation no. 2016/679 (hereinafter “GDPR”) and the Italian national legislation on the protection of personal data (hereinafter “Privacy Regulations”)

3.   DEFINITIONS AND CLASSIFICATIONS

3.1. What are Cookies. These are generally text strings that the websites (so-called Publishers, or “first parties”) visited by the user or different websites or web servers (so-called “third parties”) position and archive – directly, in the case of the publishers and indirectly, i.e., through the latter, in the case of “third parties” – within a terminal device available to the user himself.

The terminals referred to are, for example, a computer, a tablet, a smartphone, or any other device capable of storing information. Software for browsing the internet and the operation of these devices, for example browsers, can store Cookies and then transmit them again to the sites that generated them on the occasion of a subsequent visit by the same user, thus maintaining memory of his previous interaction with one or more websites. The information encoded in Cookies may include personal data, such as an IP address, a username, a unique identifier or an email address, but may also contain non-personal data, such as language settings or information about the type of device that a person is using to navigate the site. Cookies can therefore perform important and different functions, including monitoring sessions, storing information on specific configurations regarding users who access the server, facilitating the use of online content, etc. For example, they can be used to track items in an online shopping cart or information used to fill out an online form. If on the one hand it is because of Cookies that it is possible to allow, among other things, web pages to load more quickly, as well as route information over a network – therefore in line with obligations strictly connected to the operation of the websites themselves -, on the other it is  through Cookies it is also possible to convey behavioural advertising and then measure the effectiveness of the advertising message, or conform the type and methods of services rendered to the behaviour of the user subject to previous observation.

Since it is not possible to distinguish Cookies on the basis of their technical characteristics, they can be divided by origin and functionality, depending on how they are identified as:

  • First Party Cookies, which are installed directly by the Site manager on the user’s terminal;
  • Third Party Cookies, installed by a different site through the manager of the Site that the user is visiting. Cremonini acts as a mere technical intermediary for the third-party links reported below and assumes no responsibility in the event of their possible modification by the respective Controllers/Editors.
  • Technical Cookies, used for the sole purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary to the company’s service provider of information explicitly requested by the contractor or user to provide such service” (art. 122, paragraph 1 GDPR).

The legal basis for the processing of technical cookies is the legitimate interest of the site Controller which consists in the concern of making the site work and possibly carrying out statistics.

  • Profiling Cookies,  used to trace back to specific, identified or identifiable subjects, specific actions or recurring behavioural patterns in the use of the features offered (patterns) for the purpose of grouping the different profiles within homogeneous clusters of different sizes, so that it is possible for the Controller, among other things, to also modulate the provision of the service in an increasingly personalised way beyond what is strictly necessary for the provision of the service, as well as send targeted advertising messages, i.e. in line with the preferences expressed by the user in the context of the web browsing.

These Cookies can only be used with the consent of the interested party which also constitutes the legal basis of the processing. The User can never be forced, without an alternative, to express his/her consent to the receipt of cookies or other tracking tools, under penalty of being unable to access the site. We recommend you visit the website http://www.youronlinechoices.com/it for more information. By removing/rejecting these cookies, no functionality will be lost.

  • Cookie Analytics, which carry out analyses and statistics on the use of the site and the flow of the navigators. These Cookies fall into the category of technical Cookies if the possibility of directly identifying the interested party through their use is precluded (so-called single out), which is equivalent to preventing the use of Cookie Analytics which, due to their characteristics, can be direct and unique identifiers.

Analytics Cookies also fall into the category of technical Cookies if the use of statistical analyses relating to multiple domains, websites or apps are attributable to the same Controller provided that the latter carries out the statistical processing himself, without in any case such analyses resulting in an activity which, going beyond the boundaries of a mere statistical count, actually takes on the characteristics of a process aimed at making decisions of a commercial nature. The legal basis of the processing is that of technical cookies where they fall into this category or consent where they do not.

3.2    Other tracking systems. There may also be other technologies through which the same purposes undertaken with Cookies are pursued. For example, although Cookies can be used in both web and mobile browsers, it would be inappropriate to talk about Cookies in the context of mobile applications, since these are Tracking Tools that require the presence of a browser. For this reason, within this document the term Cookie is used only to specifically indicate that particular type of tracking tool. The same criteria used for Cookies apply to these technologies.

3.3    Coding criteria.  Below are the criteria with which the tracking tools are inserted under predefined categories.
